Xploreum Content Ownership & Licensing Policy

This Content Ownership & Licensing Policy ("Policy") describes the rights and permissions granted to Xploreum, Inc. ("Xploreum," "we," "us," or "our") regarding any text, images, video, audio, likeness, or other content ("Content") submitted to or captured through the Xploreum platform (the "Platform").

By using the Platform, submitting content, or participating in an Xpedition where content may be captured, you agree to the terms below.

1. Content You Submit

1.1. This includes, but is not limited to:

• Profile photos
• Xpedition listings and descriptions
• Reviews, testimonials, and feedback
• Uploaded media (e.g. route photos, packing list images)
• Text, audio, or video you post on the Platform

1.2. License Grant:

By uploading or submitting any Content to the Platform, you grant Xploreum a worldwide, irrevocable, perpetual, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, adapt, publish, publicly display, perform, and create derivative works of such Content in any media or format, now known or hereafter developed, for any lawful purpose related to the promotion, operation, and development of the Platform.

1.3. You represent and warrant that you own or have rights to the Content you submit and that its use by Xploreum will not infringe or violate the rights of any third party.

2. Content Captured During Xpeditions

2.1. Photos, video, or audio recordings ("Recordings") may be captured during Xpeditions by Thrillmasters, Xploreum staff, other participants, or automated equipment.

2.2. By participating in an Xpedition, you grant Xploreum and its authorized partners the right to use your name, likeness, voice, and image as captured in any Recordings, in perpetuity and worldwide, for purposes including but not limited to:

• Marketing and promotional content
• Social media posts
• Website media
• Event recap materials
• Commercial, editorial, or documentary use

2.3. This includes both direct and incidental inclusion in photos and videos (e.g. group shots, background captures).

2.4. Opt-Out Option:

If you do not wish for your likeness to be used, you must expressly opt out in writing prior to or at the time of the Xpedition by contacting privacy@xploreum.io or notifying your Thrillmaster.

2.5. If you opt out, Xploreum will make reasonable efforts to exclude your identifiable image from future promotional materials but cannot guarantee the removal of prior distributed content.

3. Rights of Thrillmasters and Third Parties

3.1. If you submit content created by third parties (e.g. a professional photographer or drone footage), you must have legal rights to do so and grant Xploreum the same license as outlined in Section 1.2.

3.2. Thrillmasters who upload photos of Xplorers must confirm they have obtained any required consents or have prominently disclosed the photography policy in their listing.

4. Moderation and Takedown

4.1. Xploreum reserves the right to remove or disable access to any Content or Recording at its sole discretion if it:

• Violates our policies or community guidelines
• Is subject to a credible copyright or privacy complaint
• Is offensive, illegal, or harmful

4.2. Content removal requests may be submitted to legal@xploreum.io.

5. No Compensation

You agree that you will not receive any payment, royalties, or other compensation for the use of your submitted or captured Content, unless otherwise agreed in writing.

6. Changes to This Policy

We may update this Policy periodically. Continued use of the Platform or participation in Xpeditions constitutes your acceptance of any changes.
